These General Terms and Conditions of Sale (hereinafter “GTC”) govern the online sale of used equestrian products (hereinafter “Products”) in France to any person (hereinafter the “Customer”) using the website https://dev.myver-sellerie.fr (hereinafter the “Site”).
The MYVER Sellerie website sells the following products: used equestrian items and clothing.
1 – DEFINITIONS
“Seller” refers to the company SAS MYVER, with a capital of 8,982 euros, registered with the Thonon Trade and Companies Register under SIREN number 919694729, whose registered office is located at ZA les ellieudes, 194 Rte de la Mesalière, 74520 Chênex, and whose intra-Community VAT number is FR00919694729, represented by its current manager.
The Seller can be reached by phone at the following number: Monday through Friday, as well as by email Monday through Friday via the form made available to the customer under the “Contact” tab; a response will be sent within forty-eight business hours to the registered email address. The Customer may also send an email directly, without going through the website, to the following address: hello@dev.myver-sellerie.fr
"Customer" means any natural or legal person, whether an individual or a business, who uses the Site to purchase one or more Products offered for sale online by MYVER.
The “Product” refers to any type of used equestrian products or similar items, as well as any used equipment or supplies related to horseback riding sold by MYVER online on the Website.
The “Site”: refers to the website accessible at the URL https://dev.myver-sellerie.fr
2 – PURPOSE
The purpose of these Terms and Conditions of Sale is to define the terms and conditions under which MYVER offers for sale, through its Website, a wide range of products or similar items from various brands, which it delivers to metropolitan France, Belgium, Andorra, Monaco, Switzerland, and Luxembourg.
These Terms and Conditions therefore apply to all visitors, whether business or individual customers, who access the Site via the Internet at their own expense and under their sole responsibility.
The Seller presents the Product on the Website by providing its name, condition, characteristics, and, where applicable, a description and photographs taken by MYVER. The photographs are for illustrative purposes only and are in no way binding.
The offers listed on the Site are valid while supplies last.
Offers are updated regularly to ensure that the Product’s availability can be confirmed. If, due to an error or an exceptional change imposed by MYVER, the Product is no longer available after the order has been placed, the Customer will be notified as soon as possible and may request either a refund or a replacement in accordance with the terms of Article 7.
3 – PREREQUISITES FOR ACCESS AND OPERATION
3.1. How the Site Works
The Seller makes no warranty regarding the availability or accessibility of the Site, or regarding the presence of viruses. The Seller merely endeavors to ensure a satisfactory user experience when viewing the Site’s pages.
The Seller reserves the right to suspend access to the Site and its services without prior notice in order to perform maintenance and update the information posted.
The content, layout, and functionality of the Site may also be modified, removed, or updated at any time, without notice, by MYVER, in accordance with its business policy and the operational needs of the Site.
Therefore, the Customer may only order products that are available on the Site on the day the Customer visits it.
3.2. Customer Declaration
When placing an order, the Customer represents and warrants that:
– Be legally capable of agreeing to purchase the Products offered for sale on the Site,
– Be of legal age in France (18 years old), or have the consent of a person with parental authority, a guardian, or a conservator if the individual is a minor or legally incapacitated.
3.3. Access to the Site – Personal Data
3.3.1. Orders are placed on the Website, which is accessible via the Internet 24 hours a day, 7 days a week, except in cases of force majeure or events beyond the Seller’s control, or due to maintenance, updates, or technical improvements, or to update the content and/or layout of the Website. For all orders, the Customer is responsible for any telecommunications costs incurred while accessing the Internet and using the Website.
3.3.2. When accessing the Site, and in the event of placing an order, the visitor must create an account—which requires the collection of personal data—in order to become a Customer. Personal data—with the exception of banking information—entered by the Customer to place an order is retained and may be deleted upon the Customer’s request by sending a request directly to the following address: hello@dev.myver-sellerie.fr.
The Seller reaffirms its commitment to strictly comply with Law No. 78-17 of January 6, 1978, on “Information Technology, Data Files, and Civil Liberties,” as amended by Law No. 2004-801 of August 6, 2004. In accordance with the provisions of this law, the collection and processing of the Customer’s personal data have been reported to the CNIL.
The Customer has the right to access, review, modify, correct, and delete their personal data. The Customer may exercise this right by sending an email to the following address: hello@dev.myver-sellerie.fr
4 – ORDERING
4.1. Creating an Account
To place an order for Products on the Site, the Customer must first create a customer account. The Customer must fill in required fields such as their last name, first name, date of birth, mailing and shipping addresses, email address, and, if applicable, phone number. The Customer agrees to provide accurate and truthful information and to notify the Seller of any changes to this information.
The Seller shall not be held liable for any data entry errors or the resulting consequences, such as a delay or an incorrect delivery. In such a case, all costs incurred in reshipping the order shall be borne entirely by the Customer.
When creating a customer account, the customer must also set a password, which will be required each time they wish to place an order for Products.
Once the Customer has filled out all of the above-mentioned information fields and created a password—which must remain confidential—they must click “Submit” to complete the account creation process.
4.2. Deactivating the Account
In the event of a breach of all or part of these Terms and Conditions, or in the event that incorrect data is provided, the Seller reserves the right to deactivate the Customer’s account, as of right and without any compensation, after sending an email that has remained unanswered for a period of 30 days. In the event of fraud on the part of a Customer, the account will be deactivated automatically, without prior notice and without compensation.
The Customer may also cancel their account at any time by sending an email containing all the information necessary to precisely identify the account in question by clicking on the “*contact” tab or by writing to the following address: hello@dev.myver-sellerie.fr. Upon receipt of the email, the Seller will cancel the Customer’s account within forty-eight hours. When the Customer logs in, they will see that their account is no longer active.
4.3. Placing an Order
To place an order, the Customer must follow all the instructions provided on the Website. The Customer selects the Product(s) by clicking on the product icon, which displays the product details, its main features, and its price including tax.
The Customer then confirms their selection by clicking the “Add to Cart” tab and then “Checkout.” Before final confirmation, the order is summarized, showing the complete list of selected Products along with the total price (including tax) and shipping costs.
The Customer must then confirm the order by clicking on the “Order” icon and then clicking again on the “Confirm My Order” icon. The Customer is asked to carefully review the order details and total price, and to correct any errors, before confirming the order to indicate acceptance.
The “double-click” associated with the authentication process—that is, when the Customer logs in using their password—constitutes a valid electronic signature under French law.
4.4. Order Confirmation
4.4.1. If a problem causes a product to be listed at a ridiculously low price, the seller may have to cancel the order.
4.4.2. The Seller then confirms receipt of the order for the Product(s) by sending an automated email that lists the essential details of the order, including the order number, the payment reference from the secure website, the price including tax, shipping costs, and, if applicable, any issues or reservations regarding the order placed.
4.4.3. The customer must check the box labeled “I accept the General Terms and Conditions of Sale” when placing any new order, thereby indicating their unconditional acceptance of these General Terms and Conditions of Sale, which take precedence over any other document whatsoever. Pursuant to the provisions of Article 1369-1 of the Civil Code, these General Terms and Conditions of Sale may be viewed by anyone visiting the website; they may also be downloaded and printed.
5 – PRICES – PAYMENT TERMS
5.1. Prices
Prices are quoted in euros, regardless of the country to which the Products are shipped, and include all taxes. The Seller reserves the right to change its prices at any time; however, the Products will be billed to the Customer based on the rates in effect at the time the order is confirmed.
The prices listed on the product pages include handling, packaging, and storage fees for the products, but do not include shipping costs.
For sales made in France, the order summary provided before confirmation shows, in addition to the listed price, the total amount including VAT and shipping costs. However, sales to customers subject to VAT will not be subject to VAT in France but in the customer’s country of residence; the customer must simply provide their VAT identification number to the Seller.
For sales made outside the European Union and the French overseas departments and territories, the price is exclusive of taxes. However, customs duties, import duties, state taxes, or other local taxes may be applicable. The payment of these duties, as well as the completion of all customs formalities or other declarations with the relevant authorities, is the sole responsibility of the Customer, as the importer; the Seller assumes no liability in this regard.
Sales prices are listed in euros, including tax but excluding shipping costs, as are the suggested retail prices, which are reference prices derived from supplier data regarding the sale of these same products on the domestic market by distributors of the same product.
5.2. Payment
Payment on the Site is made by credit card: cards from the Carte Bleue, Visa, and Eurocard/Mastercard networks are accepted, but American Express cards are not accepted—via a secure payment system. Payment must be made at the time of ordering. Any transmission of payment-related information—in particular, the transmission of a credit card number, its security code, and its expiration date—takes place in a secure environment using current Internet protocols on the server of the Seller’s service provider: CREDIT MUTUEL.
Any order paid for by credit card is considered final only once the relevant payment processors have approved it. When the order is charged, if the payment is irregular, incomplete, or does not go through—for any reason whatsoever—the Seller reserves the right to suspend delivery of the ordered products. The Customer will be notified of this by email. In any event, the products ordered remain the property of the Seller until the Customer has paid the full price and any applicable fees.

You enter your personal information or, if you have a 3x 4x Oney account, you log in using the login credentials associated with your 3x 4x Oney account. You review the terms and conditions for the installment payment plan you wish to enroll in, which are provided to you in PDF format so that you can read, print, and save them before accepting them.
You then confirm your electronic acceptance by checking the corresponding box.

Oney Bank reserves the right to accept or reject your application for 3x or 4x Oney financing. You have a 14-day withdrawal period to cancel your credit agreement.
How It Works: Paying in 3 or 4 installments by credit card allows you to pay for your order placed on our online store as follows:
– a mandatory down payment, charged on the day your order’s shipment is confirmed;
– two or three monthly payments, each corresponding to one-third or one-quarter of the order total, charged 30 and 60 days later for the 3-installment plan and 30, 60, and 90 days later for the 4-installment plan. These installments include, in the case of 3x or 4x plans with fees, a fee equal to 1.45% of the total order amount for a 3-installment plan and 2.2% for a 4-installment plan (capped at a maximum of €15 for a 3-installment plan and €30 for a 4-installment plan). 5.3. Invoice
The invoice is issued when the order is shipped to the Customer; the invoice is sent to the paying Customer via email. The invoice can be viewed by logging into the customer account, and it can be printed.
6 – DELIVERY AND SHIPPING
Excluding sales periods and the holiday season (when high order volume may result in additional shipping delays), any order placed on the MYVER website before noon Monday through Friday (excluding holidays) will be prepared and shipped within 48 hours, provided the product is in stock and payment has been confirmed (see the following section, “Payment”). The customer’s order will be delivered either by Chronopost to their home or to a Shop2Shop pickup location.
We offer two shipping options via Chronopost, the terms of which are outlined below:
Chrono Shop2Shop
Delivery is made to a pickup location chosen by the customer. The estimated delivery time is generally between 2 and 5 business days from the time Chronopost picks up the package. This timeframe is provided for informational purposes only and is not guaranteed. Myver shall not be held liable in the event of a delay or failure to deliver within this timeframe.
Chrono 18
Delivery is made to the address provided by the customer, with a guarantee of next-day delivery by 6:00 p.m., provided that the order was shipped within the required timeframe. This service offers a firm delivery time guarantee.
Products are shipped with a packing slip to the delivery address provided by the customer when placing the order. Products ordered on the website https://dev.myver-sellerie.fr are available for delivery throughout mainland France, Belgium, Andorra, Monaco, Switzerland, and Luxembourg.
-Delivery charges for orders up to 89 € (including tax) are the responsibility of the customer and are determined by Chronopost and Chronoshop2shop, which set their prices based on the package’s weight and the destination country. (until further notice).
-For orders totaling more than 89 € (including tax), delivery to Chronopost and Chronoshop2shop pickup points in France and Belgium is free.
6.1 – Delivery Errors
The buyer must submit any claim regarding a delivery error and/or non-conformity of the products in terms of type or quality compared to the information on the purchase order to the seller on the day of delivery or, at the latest, on the first business day following delivery. Any claim submitted after this deadline will be rejected.

Any claim not made in accordance with the rules set forth above and within the specified time limits will not be considered and will release the seller from any liability toward the buyer.
If a package is returned to the sender (Myver) for any of the following reasons:
– package not claimed within the timeframe specified by the carrier,
– delivery refused by the customer,
– incomplete, incorrect, or erroneous delivery address provided at the time of order,
The order will not be automatically reshipped.
The customer will be notified that the package has been returned and will have 30 calendar days to respond. If no response is received within this period, the order will be considered a return made outside the legal withdrawal period, and the customer will receive a refund for the product(s), excluding the initial shipping costs.
If the customer wishes to have the order reshipped, they will be responsible for new shipping charges, which must be paid in advance of any new shipment.
7 – UNAVAILABILITY – NON-CONFORMITY OF THE PRODUCT OR ORDER AND WARRANTY
7.1 If the ordered product is unavailable, the customer may either receive a refund no later than thirty (30) days from the date of payment, or receive a replacement product of equivalent quality and price.
7.2 The Products sold on the website https://dev.myver-sellerie.fr comply with current French regulations and are designed for non-professional use.
The Seller is subject to the statutory warranty provisions set forth in Articles L. 211-4, L. 211-5, and L. 211-12 of the French Consumer Code and Articles 1641 and 1648 of the French Civil Code: The Products supplied by the Seller are automatically covered, at no additional cost and independently of the right of withdrawal, in accordance with legal provisions,
- by the statutory warranty of conformity, for Products that are apparently defective, damaged, or do not correspond to the order,
- the statutory warranty against hidden defects arising from a defect in material, design, or manufacture that affects the delivered products and renders them unfit for use,
under the conditions and in accordance with the terms set forth in the box below and defined in the appendix to these General Terms and Conditions of Sale (Warranty of Conformity / Warranty Against Hidden Defects).
It is noted that, under the statutory warranty of conformity, the Customer has a period of two years from the delivery of the goods to take action against the Seller and may choose between repair or replacement of the ordered Product, subject to the cost conditions set forth in Article L 217-9 of the Consumer Code; is exempt from providing proof of the Product’s lack of conformity during the six months following delivery of the Product. This period is extended to 24 months, except for used goods. The statutory warranty of conformity applies independently of any commercial warranty that may cover the Product. The Customer may decide to invoke the warranty against hidden defects in the “Product” in accordance with Article 1641 of the Civil Code; in this case, the Customer may choose between rescission of the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code.
The Customer or any person authorized by the Customer must verify that the product complies with the order upon delivery and sign the delivery slip. Any discrepancy, missing product, or damage to the shipment must be noted on the delivery slip and then confirmed within 48 business hours of receipt via registered letter with return receipt requested, addressed to the carrier with a copy to the Seller. The Product must be returned to the Seller in its original condition within the same timeframe; otherwise, the claim cannot be accepted.
The Seller agrees to refund the Customer or exchange any Products that appear to be damaged or do not match the Customer’s order. The Seller will, at the Customer’s discretion, exchange or refund the Product(s). Shipping costs will be refunded to the Customer based on the invoiced rate, and return shipping costs will be refunded upon presentation of supporting documentation. Refunds for Products will be issued as soon as possible and no later than 30 days following the date on which the right to return was exercised. The refund will be issued, at the Seller’s discretion, by crediting the Customer’s bank account.
The Seller shall not be held liable in the following cases:
– failure to comply with the laws of the country to which the products are delivered, which the Customer is responsible for verifying;
– in the event of misuse, use for professional purposes, negligence, or lack of maintenance on the part of the Customer, as well as in cases of normal wear and tear of the Product, accident, or force majeure.
The Seller’s warranty is, in any event, limited to the replacement or refund of Products that are non-conforming or defective.
8 – LIABILITY
The Seller shall not be held liable in the event that its failure to perform its obligations is attributable either to the Customer, to an unforeseeable and insurmountable act by a third party not party to the contract, or to a force majeure event as defined by French case law. Similarly, the Seller shall not be held liable for any inconvenience or damage inherent in the use of the Internet, including service interruptions, external intrusions, or the presence of computer viruses.
9 – WITHDRAWAL
The right of withdrawal and the return of items are available only for orders placed in France, Belgium, Germany, Italy, the Netherlands, and Spain. It is not possible to request a return for orders delivered to Switzerland or other countries not listed above. In accordance with applicable legal provisions, the Customer has fourteen (14) days from the date of receipt of the ordered Products to exercise their right of withdrawal, without having to provide a reason for their decision or incur any costs other than those related to return shipping. In any event, these provisions do not apply to transactions between businesses and are therefore inapplicable to contracts entered into with business Customers or Customers acting in a professional capacity.
The Customer has 7 days from the date the right of withdrawal is exercised to return the ordered Products in their original condition, unopened, and complete (including packaging, accessories, instructions, etc.), so that they can be resold in the same condition as when MYVER sold them.
If the Customer exercises their right of withdrawal, the Seller agrees to refund the amounts paid, excluding any shipping costs, within 7 days of receiving the returned Products, using the same payment method the Customer used when placing the order.
Return shipping costs, estimated at €5.99 from France, €5.99 from Belgium, €7.99 from Germany, €7.99 from Spain, and €14.49 from Italy, are the customer’s responsibility and will be deducted from the refund.

10 – INTELLECTUAL PROPERTY
The Site is the exclusive property of the Seller, as are all rights pertaining thereto. Any use, extraction, or reproduction, in whole or in part, is prohibited without the express written consent of MYVER.
. However, the use of hyperlinks to the Site is permitted without a specific request.
Since the photographs, descriptions, and product specifications are not binding, the Seller cannot be held liable for any errors or omissions in said descriptions, or for any changes to or unavailability of the products.
11 – ARCHIVING
The “Confirm” icon associated with the password authentication, automatic recording, and message integrity protection procedures in the seller’s computer systems constitutes proof of the nature, content, and date of the order, as well as the Customer’s consent.
Purchase orders and invoices are archived on a reliable and durable medium and stored under reasonable security conditions within the Seller’s computer systems. Upon request, the Customer may receive an electronic copy of the order or invoice; the Customer may also reprint invoices via the Customer account interface.
12 – AMENDMENTS TO THE GENERAL TERMS AND CONDITIONS OF SALE
MYVER reserves the right to modify or update, at any time, the pages of the Site, the Products, the Product descriptions, the photographs, or even the General Terms and Conditions of Sale applicable to it. These amendments will take effect as soon as they are posted on the Site.
13 – DISPUTE RESOLUTION
13.1 Mediation
Pursuant to Article L. 612-1 of the Consumer Code, “Every consumer has the right to seek the assistance of a consumer mediator, free of charge, with a view to reaching an amicable resolution of a dispute with a business.”
Within one year of our department receiving any complaint, pursuant to Article R. 616-1 of the Consumer Code, the Customer may have their request reviewed by a mediator whose contact information is provided below, noting that, barring exceptions, a dispute may be reviewed by only one mediator:

On that occasion, the Client may, at his or her own expense, be represented by any attorney of his or her choice.
13.2 These General Terms and Conditions of Sale are governed by French law. In the event of a dispute, the parties shall seek an amicable resolution. Such efforts to reach an amicable resolution shall in no way interrupt the time limits for bringing warranty claims. Failing that, and in accordance with the provisions of Articles 46 through 48 of the Code of Civil Procedure, the French courts shall have exclusive jurisdiction.
14 – PRE-CONTRACTUAL INFORMATION
14.1 The Customer acknowledges that, prior to placing an order and entering into the contract, he or she was provided, in a legible and understandable manner, with these General Terms and Conditions of Sale and all the information listed in Article L. 221-5 of the Consumer Code.
14.2 The following information is provided to the Customer in a clear and understandable manner:
– the essential characteristics of the Products;
– the price of the Products;
– the condition of the Products;
– all additional transportation, delivery, or postage costs and any other applicable fees;
– the date or timeframe by which the Seller agrees to deliver the goods, regardless of their price;
– information regarding the Seller’s identity, mailing address, telephone number, and email address, as well as its business activities; information regarding statutory warranties and the procedures for enforcing such warranties; and other contractual terms and conditions.
14.3 The Seller shall provide the Customer with the following information:
– the Seller’s name or corporate name, the physical address of its place of business, and, if different, the address of its corporate headquarters, as well as its telephone number and email address;
– the terms and conditions governing payment, delivery, and performance of the contract, as well as the Seller’s procedures for handling complaints;
– the existence and terms for exercising the statutory warranty of conformity provided for in Articles L. 217-1 et seq. of the Consumer Code, the warranty against hidden defects provided for in Articles 1641 et seq. of the Civil Code, as well as, where applicable, the commercial warranty and after-sales service referred to in Articles L. 217-15 and L. 217-17 of the Consumer Code, respectively;
15 – PRIVACY
All personal data provided by the Customer on the dev.myver-sellerie.fr website is subject to computerized processing for the purposes of processing and delivering orders, selecting complimentary samples, and suggesting products tailored to the Customer’s needs. This data is exclusively reserved for MYVER
.In accordance with the amended French Data Protection Act No. 78-17 of January 6, 1978, the processing of the Customer’s personal data has been declared to the CNIL, and the Customer has the right to access, modify, correct, and delete data concerning them by contacting MYVER at 90 chemin des cotes, 74350 Cernex. APPENDIX I – PROVISIONS REGARDING LEGAL WARRANTIES
Article L217-4 of the Consumer Code
The seller must deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery.
The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when such installation was the seller’s responsibility under the contract or was carried out under the seller’s supervision.
Article L217-5 of the Consumer Code
The goods are in conformity with the contract:
1° If they are fit for the purpose usually expected of similar goods and, where applicable:
– if they correspond to the description provided by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model;
– whether it possesses the qualities that a buyer may legitimately expect in light of public statements made by the seller, the manufacturer, or their representative, particularly in advertising or on labeling;
2° Or if it possesses the characteristics defined by mutual agreement between the parties or is suitable for any special purpose sought by the buyer, which was brought to the seller’s attention and which the seller accepted.
Article L217-12 of the Consumer Code
The right to bring an action for lack of conformity expires two years after the delivery of the goods.
Article L217-16 of the Consumer Code
When the buyer requests that the seller, during the term of the commercial warranty granted to the buyer upon the purchase or repair of a movable good, perform repairs covered by the warranty, any period of downtime of at least seven days shall be added to the remaining term of the warranty.
This period begins on the date of the buyer’s request for service or on the date the item in question is made available for repair, if such availability occurs after the request for service.
Article 1641 of the Civil Code
The seller is liable under the warranty for hidden defects in the item sold that render it unfit for its intended use, or that so impair such use that the buyer would not have purchased it, or would have paid only a lower price for it, had the buyer known of such defects.
Article 1648, paragraph 1, of the Civil Code
An action arising from latent defects must be brought by the purchaser within two years of the discovery of the defect.
